By creating an account, accessing, or using elfclick, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the platform.

You must be at least 18 years old and legally capable of entering into contracts to use elfclick. By using our services, you represent that you meet these requirements.

elfclick provides tools for small and medium businesses to create storefronts, manage menus/products, and interact with customers via messaging platforms including WhatsApp. We act as a technology intermediary and are not responsible for the products or services offered by business users.

• Our WhatsApp integration uses the Meta WhatsApp Business API. By enabling this feature, you agree to Meta's terms and policies.
• You are responsible for all messages sent through your account and must comply with WhatsApp's messaging guidelines and Canada's Anti-Spam Legislation (CASL).
• Customer opt-in: When a customer first contacts your business through elfclick, they receive a notice informing them that your business may send follow-up messages. Customers who reply STOP to any business-initiated message will be immediately removed from all future follow-ups, reorder reminders, and broadcasts. You must not attempt to circumvent this opt-out mechanism.
• Your opt-out obligations: You agree to honour all customer opt-out requests and not to message customers who have opted out. elfclick enforces this automatically, but you remain legally responsible for compliance with CASL and Meta's messaging policies.
• elfclick is not liable for disruptions, changes, or restrictions imposed by Meta or other third-party platforms.

• elfclick uses AI to assist with business automation, customer interaction, and catalog management.
• AI-generated responses are not guaranteed to be accurate. You are responsible for reviewing and verifying any AI-generated content before it is used publicly or sent to customers.
• Do not rely solely on AI outputs for critical business or legal decisions.

• You are solely responsible for the accuracy of your product listings, pricing, and descriptions.
• You must comply with all applicable local, national, and international laws, including consumer protection, health and safety, and industry-specific regulations applicable to your business type.
• You agree not to use elfclick for illegal, misleading, or harmful activities.

• elfclick facilitates communication between businesses and customers but is not a party to any transaction.
• Disputes between business owners and customers are solely between those parties. elfclick will not mediate or be held liable for such disputes.

Your use of elfclick is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

• Certain features may require a paid subscription. Billing terms will be presented before any charges are made.
• Refunds are handled on a case-by-case basis. Contact us at support@elfclick.com for billing inquiries.
• We reserve the right to modify pricing with reasonable notice.
• Prices quoted are in Canadian dollars (CAD) and are exclusive of applicable taxes. Canadian merchants may be subject to Goods and Services Tax / Harmonized Sales Tax (GST/HST) at the rate applicable to their province.

• elfclick and its original content, features, and functionality are owned by elfclick and protected by applicable intellectual property laws.
• You retain ownership of content you upload but grant elfclick a non-exclusive license to display and process it in connection with our services.

To the maximum extent permitted by law, elfclick shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities.

You agree to indemnify and hold harmless elfclick, its affiliates, and their employees from any claims, damages, or expenses arising from your use of the platform or violation of these Terms.

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in behavior that harms the platform or other users.

Self-serve deletion: You may permanently delete your account at any time from Settings → Delete Account. Deletion removes your business profile, catalog, orders, customer data, and all associated content immediately. This action is irreversible. We retain only data required by applicable law (e.g., tax and financial records) for the legally mandated period, after which it is securely purged. This right is guaranteed under the Personal Information Protection and Electronic Documents Act (PIPEDA).

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved exclusively in the courts of Ontario.
